(23rd December, 2019) Emperor Group is pleased to announce that the Group’s trademark, “Emperor (英皇) ”and “Emperor Watch and Jewellery and the crown-shaped icon (英皇鐘錶珠寶及皇冠圖形)” have been recognized as “Well-known Trademark” by the National Intellectual Property Administration, affirming the wide acknowledgment in China and the brand’s reputation which continuous for nearly 80 years. At the same time, the recognition can effectively protect the Group and its businesses from trademark counterfeiting and plays a great role in copyright infringement.
Since 1942, Emperor Group has grown into a diversified group of businesses that include financial services, property, watch and jewellery, entertainment, hospitality, media, furniture and furnishing, esports as well as co-working space. The segment of watch and jewellery which the Group is deeply rooted in, its retail network spanning Mainland China, Hong Kong, Macau, Singapore, and Malaysia. Emperor Watch and Jewellery Limited (stock code: 887) is listed on the Main Board of The Stock Exchange of Hong Kong in the year 2008. Recently, the Group has prevailed in the third cross-class trademark infringement cases and eventually affirmed the recognition to the registered trademark of Emperor Watch and Jewellery Limited “Emperor ‘英皇’ wordmark (No. 924354)"; “Emperor Watch and Jewellery & the crown-shaped icon ‘英皇鐘錶珠寶及皇冠圖形’ combined mark of word and graphic (No. 116000)” under protection of “Well-known Trademark”, in contrary, related imitators were judged to have failed on granting the trademark registration to prevent confusion to consumers about the goods of origin.
The “Chinese Well-known Trademark” is protected by corresponding regulations and articles under PRC Trademark Law, has obtained the cross-class trademark protection. In other words, the owner of “Well-known Trademark” would be entitled to initiate legal actions against registration and/or use of an identical or similar mark even under different classes.
Well-known Trademarks entitle the protection in contracting states in accordance with their international obligations under the Paris Convention for the Protection of Industrial Property and the Agreement on Trade-Related Aspects of Intellectual Property Rights (the TRIPS Agreement). Therefore, apart from cracking down both national and international infringing activities in the future, by acquiring the recognition, the Group has also been dedicated to brand reputation management and maintenance; as well as strengthening brand awareness and value which is a big step forward of future brand building.
